The EU seed marketing legislation sets the framework for the free movement of seeds among the Member States and establishes a ‘common seed market’ in the EU. It ensures that only good quality seeds of improved varieties are put on the European market to promote innovation and competitiveness of European agriculture, by allowing for the quick and effective transfer and sharing of new plant varieties with all farmers and growers across the EU.

Beyond these main goals, the legislation aims to achieve the harmonisation of many technical requirements and to contribute on other important policy objectives such as sustainability and biodiversity.

The European common market for seeds has allowed breeders to access new markets, has provided the European seed industry with a fair and competitive environment; and it has provided farmers and growers with the necessary innovation, increasing quality and choice. It ensures the due protection of consumers and has made more biodiversity available to users of seed than ever before.

Overall, Europe’s seed marketing legislation has been a very successful tool to facilitate the entry of ever better plant varieties to the EU market.

Better Regulation for Plant Reproductive Material

The current EU seed legislation is complex. It consists of 12 basic Directives and many implementing measures that have been developed over a period of almost 50 years. To streamline and focus all these rules, the Commission launched a review process under its “Better Regulation” approach in 2008 with the objective of maintaining the successful pillars of the legislation while modernizing and improving its effectiveness and efficiency. The aim is to bundle all ‘Plant Reproductive Material’ under a single Regulation that sets basic common principles but still allows for the necessary differentiation according to biology of crops or specific markets.
